    IMPORTANT NOTICE

    • These competition rules contain certain terms and conditions which appear in similar text style to this clause and which:
      • may limit the risk or liability of the promoter or a third party; and/or
      • may create risk or liability for the entrant; and/or
      • may compel the entrant to indemnify the promoter or a third party; and/or
      • serves as an acknowledgement, by the entrant, of a fact.
    • The entrant cannot be a juristic entity and must be a natural person.
    • The entrant’s attention is drawn to these terms and conditions because they are important and should be carefully noted.
    • Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“the CPA”).
    • The entrant acknowledges that by submitting his or her entry to the competition s/he has been given an appropriate opportunity to first read these terms and conditions before entering and that s/he understands and agrees to the terms and conditions.
    • All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless to FHA Fitness Health Active and 5 Colour Fitness, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.

    RULES OF THE COMPETITION

    • This promotional competition opens on 17 August 2021 at 07:00 and closes on 17 September 2021 at 23:00; thereafter no late entries received will be considered.
    • The winners will be announced on the FHA Social Media pages on 22 September 2021.
    • The prizes include: A 1 night stay for two including breakfast at the Brahman Hills Hotel in KZN valued at R2500, 2 x LeCreset Hydration Bottles valued at R1000, 2 x Cosmetix Hampers valued at R500 for both and 1 x cash prize of R1000.
    • The total prize value for the competition is R5000 (Five Thousand Rand) and 5 Winners will be chosen per prize indicated above.
    • A total of 5 winners will be drawn and announced on the FHA social media pages.
    • The winners will be selected using an online random winner selector.
    • No substitution or assignment of prizes is permitted.
    • The prize will be delivered to the winner via an email for the Brahman Hills Hotel voucher, via courier for the LeCreset and Cosmetix Prizes and via electronic bank transfer for the cash prize from FHA. The prize takes 3-4 weeks to be processed from the date the winner submits his/her details to FHA.
    • Nobody other than the prize winner will be allowed to sign for the prize.

     

    • The winner will need to produce valid identification (ID Number), address details, bank account details and contact details via email to FHA to claim the prize.
    • One entry per person, the more you post and share on social media the better your changes are of winning the prize. However, 1 online entry form entry is required of you to fill in your details to confirm your participation. By filling in the entry form numerous times does not allow more entries under your own name.

    To qualify as an entrant for this promotional competition, the following requirements must be met by each entrant:

    • The entrant must provide correct and full personal details (name, surname, identity number), as required.
    • The entrant must be 15 years old or older, with consent from your parent that you are allowed to accept the prize in writing.
    • The entrant cannot be a juristic entity and must be natural person.
    • By entering the competition, the entrant hereby warrants that all information submitted is true, current and complete.

    GENERAL

    • FHA reserve the right to amend the terms and conditions, as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against FHA , its advertising agencies, advisors, suppliers and nominated agents.
    • By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 (“CPA”) and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number), and (ii), signing receipt of the prize upon its delivery.
    • The Competition Rules will be governed by the laws of the Republic of South Africa and any and all disputes will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
    • The name of the prize winner will be published on the FHA social media pages.
    • The winner may be requested to take part in the promoter’s publicity campaigns or to allow their names and likenesses to be used by the promoter for promotional purposes. The winner is, however, entitled to decline such request.
    • The promoters shall conduct the competition, and the promoters’ decision on any matter related to the competition, including the selection of prize winner, is final and no correspondence or discussion will be entered.
